Breaking News: New HO guidance on Covid for Migrants

This is Paul Turner the Immigration Barrister at Imperium Chambers

New HO guidance on Migrants and Covid –

This is the HO most up to date guidance issued today.

If you have any doubts about your status – then please

I will deal today with those in the UK to avoid the video being long or too boring…

Perhaps unreasonably the HO despite the second wave or Tsunami of Covid cases – expects you to leave the UK.
However

You are allowed to make applications for regularisation.

If you visa ran out between 1 December 2020 and 31 January 2021 you may request “exceptional assurance” to allow you to remain, you will need to show that you have tried to go home but can’t – I can help if this applies –

The good news is that you will not be treated as an overstayer.

If you previously had exceptional assurance you will need to reapply again.
As I have said – it is vital that you contact a lawyer to protect your position.

Positive news – is that you can make an application from within the UK whereas before they would expect you to go home – and your leave will remain the same.

More positive, news, that if you are switching to work or study you maybe able to start work or study while the HO considers your application.

Overstayers from 24 January 2020 till 31 August 2020 will not be penalised – but you should make an application urgently.

Most UK Visa and Citizenship Application Centres (UKVCAS) have reopened for existing customers. You can check which UKVCAS centres are open and book an appointment
Service and Support Centres (SSCs) are essential services and will remain open..

You can book a test at most of the approved English Testing Centres in the UK, check with relevant centres as some have opened.

Good news for Tier 1 Entrepreneurs – they no longer need to rely on 2 people for 12 consecutive months if they can make up the period.

Start visa migrants can apply for additional leave of 12 months. This will allow your Start-up visa to go beyond the normal maximum 2-year period

Students and Tier 2 workers can start studying and working while waiting for a decision

There are still concessions for NHS workers – who will be eligible for a free extension to their visa if it ends between 1 October 2020 and 31 March 2021.

However there will not be automatic extensions so please check with your employer or me.

You can also work at a different NHS site. in fact any NHS site and sponsors do not need to notify the HO.

If you have limited hours – these limits are lifted due to the Coronavirus Pandemic.

The Ho allows people to volunteer for the NHS – which could be a good way of showing commitment to the UK.

If you have any problems or uncertain about your status – please contact me urgently.
